Built for the Heat: Improving OSHA Compliance on Construction Sites

OSHA’s heat illness requirements have been in place for some time, but construction employers still have opportunities to strengthen their heat safety programs.


Construction is one of the highest-risk industries for heat illness in the United States, and Florida’s climate makes it one of the most urgent. Workers are outside, often in direct sun, wearing heavy gear, working at physical intensity for hours at a stretch. With OSHA’s revised National Emphasis Program focusing inspections and outreach in industries and workplaces where heat stress risks are most likely to occur, including construction sites, the question for employers is whether your program is actually ready.

What OSHA Actually Requires

OSHA doesn’t currently have a specific heat illness standard for construction, but it enforces heat safety under the General Duty Clause, which requires employers to provide a workplace free from recognized hazards that are causing or likely to cause death or serious harm. In practice, OSHA expects construction employers to have the following in place:

  • Water, rest, and shade. These are OSHA’s foundational requirements for outdoor workers in heat: cool drinking water accessible at all times, regular rest breaks, and shaded or cool rest areas.
  • Training for workers and supervisors. Everyone on the crew, not just supervisors, should be able to recognize the signs of heat exhaustion and heat stroke and know how to respond.

Where Employers Can Strengthen Their Approach

The most common compliance failures in construction:

  • Acclimatization isn’t happening. A returning worker who’s been off for two weeks is treated the same as someone who’s been on the job all summer. That’s a compliance gap and a safety risk.
  • Supervisors know the signs but haven’t changed the workflow. Recognizing heat exhaustion doesn’t help if rest breaks aren’t built into the schedule and shade isn’t accessible during peak heat hours.
  • Training is a checkbox, not a practice. A one-time toolbox talk at the start of the season doesn’t meet OSHA’s expectation of meaningful, ongoing worker education, especially as crews rotate and conditions change.
  • PPE isn’t fitted for women. This one doesn’t show up in enough compliance conversations, but it should. As more women enter Florida’s construction workforce, standard-issue PPE that isn’t designed for women’s bodies creates real safety gaps. Ill-fitting gear affects heat regulation, mobility, and protection; and OSHA’s General Duty Clause applies here too. Employers have an obligation to provide PPE that actually fits and protects every worker on the crew.

What We’re Seeing in the Field

TREEO’s Cindy Mercado has been delivering OSHA 10 Construction Industry training to workers in Central Florida, including participants in FDOT’s Moving I-4 Forward Workforce Development Program, an initiative building the pipeline of skilled workers needed to support over 1,500 positions across the I-4 corridor improvements.

The feedback from those sessions says a lot about where the real gaps are. Students consistently highlight PPE education, hands-on activities, and clear explanations of OSHA standards as the most valuable parts of the training. What that tells us: workers want to understand the why behind the rules, not just the rules themselves. And when they do, they retain it.

That’s the difference between compliance training and safety culture, and it’s exactly what OSHA is looking for when they show up on your site.

What to do Before OSHA Shows Up

With compliance officers prioritizing inspections during heat advisories and National Weather Service, here’s what every construction employer should have in place now:

  • A written heat illness prevention plan.
  • A documented acclimatization protocol for new hires and returning workers.
  • Water, rest, and shade accessible during every shift.
  • Supervisors trained to recognize warning signs and empowered to act on them.
  • PPE assessed and fitted for every worker.
  • A clear emergency action plan that every person on the site knows.
